A German test driver nicknamed Turbo Rolf escaped jail on appeal today over the deaths of a mother and her young daughter after tailgating her on the motorway at up to 250 kilometres per hour.

The 35-year-old employee of DaimlerChrysler was found guilty in February of negligent homicide and sentenced to 18 months in prison for having driven his top-of-the-line Mercedes to within a few metres of the woman's car last July.

Intimidated by his aggressive driving, the 21-year-old mother swerved to the right, sending her compact car into a tailspin and crashing into a tree, killing her and her two-year-old daughter instantly.

The state court in the southern city of Karlsruhe upheld his conviction but reduced the punishment on appeal to a one-year suspended sentence.

Presiding judge Harald Kiwull said that the defendant's loss of his dream job at DaimlerChrysler and the public stigma of his conviction were punishment enough.

However, Kiwull set the bail at an unusually high 12,000 euro ($A20,700), which he said should remind him of his guilt.

He added that the defendant had done little to cooperate with the court, noting that without the precise and credible testimony of witnesses and exhaustive police work, the driver of the Mercedes might never have been found.

But Kiwull said that the prosecution had failed to prove that the accused was a "Road Rambo" who habitually violated traffic laws, noting there was no speed limit on the stretch of autobahn where the accident took place.

"If you don't like it, you've got to look at speed limits," said Kiwull in anticipation of public outrage about the relatively lenient judgment in the high-profile case.

The accused, identified according to German legal practice only as Rolf F, said he was "disappointed" despite the reduced sentence and would appeal the ruling. He would only be able to reclaim his job if he is acquitted by the higher court.

Koliko sam uspio vidjeti ovaj u BMW-u se nikome nije lijepo za guzicu.

Koliko sam uspio vidjeti ovaj u BMW-u se nikome nije lijepo za guzicu.

Nije se lijepio ali jeste bas naglo se priblizio jer je brzo vozio sto moze imati isti efekat odnosno da vozac Mazde usljed toga nekom reakcijom iz straha, napravi nesrecu.

Ja u principu mislim da je podjeljena odgovornost u ovom slucaju, sto sam napisao u prvom postu.
