Evo ti malo materijala sa interesantnog vjerskog sajta gdje vjernici (kada su u nedoumici) postavljaju pitanja i traže odgovore. Ovo mi izgleda kao mjesto za zvanična tumačenja šta se smije a šta ne po islamu. Najinteresantnije je da se stvari mogu tumaciti na vise nacina, kao i to da se anatomija moze uciti ali najbolje na tijelima nemuslimana!?
Na žalost, ovo je na Engleskom i nije mi se dalo prevoditi. A ima i drugih pitanja i fascinantnih ali i zakukuljenih odgovora.

Is it permissible to exhume the bones of the deceased for science and research?
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, is His slave and messenger.
The wise legislation of the Sharee‘ah The Almighty has prohibited the exhumation and misuse of graves out of respect for the deceased and has made the breaking of the bones of the deceased like breaking the bones of the living. ‘The Prophet said: “Breaking a bone of the dead is like breaking it while he is alive.” [Ahmad, Abu Daawood and Ibn Maajah] He also said: “Do not sit on graves nor pray on them.” [Muslim]
Furthermore, the foundations of the Sharee‘ah require taking and maximizing benefits while deflecting and minimizing evils.
As such, if an autopsy will result in benefit or aversion of evil, and there is no other way to achieve this, then it is allowed. If an autopsy is necessary in this case, then it is most appropriate to perform it on a body that has not yet been buried in order to avoid exhuming the grave. But, in the case that the autopsy requires someone who has already been buried, then there is no restriction in exhuming the bones of the deceased at that time.

What is your opinion about postmortem examination of a dead body to learn the reason of death?

Praise be to Allah, the Lord of the Worlds; and may His blessings and peace be upon our Prophet Muhammad and upon all his Family and Companions.
First of all, know that Shariah recommends highly that the dead be buried as soon as possible. The Prophet (Sallallahu Alaihi wa Sallam) said: "Hasten to bury your dead. If the dead person was good, then you will be presenting him to something better. And if he was otherwise, it is a bad (burden) you take off your necks (shoulders)". [Reported by Imams Al Bukhari and Muslim]
However, if there is an advantage in delaying the burial such as examining the corpse to detect the cause of the death if there is probability that the dead person was murdered or the like, then this is lawful, provided the medical examination is not an autopsy. In fact, the anatomization of the human body is forbidden regardless of whether it is the body of a Muslim or a non-Muslim. This prohibition is more emphatic when the body is of a Muslim.
However, if there is a considerable advantage in dissecting the corpse then that is greater than the sanctity of the corpse itself.
But if this dissection is necessary, it should be done to the corpse of a non-Muslim and if there is any other way that could be used to get the required knowledge, then it becomes unlawful to make an autopsy on dead body.
Our Fatwa is the same as Fatawa on the same subject issued by the following:
- The Supreme Council of the most Eminent scholars in Saudi Arabia.
- The Islamic Fiqh Council in its tenth session.
- The Committee of Fatwa in Al Azhar on the 29th February 1971.
