MILENKO KRSTIC ASSISTED IN GENOCIDE

Milenko Krstic (52), the father of Miss Oregon, was a member of a Bosnian Serb army's Zvornik brigade that participated in the mass killings of 8,000 to 10,000 unarmed Bosniaks (Muslims) and a forcible deportation at least 25,000 people during the 1995 Srebrenica genocide. Krstic admittedly worked in the headquarters of the genocidal army, providing logistical support to the unit responsible for terrorizing and committing genocide against Muslims in and around Srebrenica.

Milenko Krstic's family has a comfortable life in the United States, while bodies of Muslim victims, many of them children, rot in Srebrenica genocide mass graves. His daughter, Danijela Krstic (24), was crowned in June and serves as queen of the Oregon pageant. She failed to make the top 15 in the Miss America pageant and didn't make the finals.

We found Daniela Krstic's publicly listed E-mail address ([email protected]) via The Oregonian article. We asked her, "Does your father intend to apologize to the relatives of Srebrenica genocide victims for actively serving in the genocidal army?"

She hasn't responded to our question, yet. Like most Serbs, she must be proud of her father's involvement in the extermination of Srebrenica Muslims. After all, it is no secret that majority of Serbs suffer from extreme Bosniakophobia - a prejudice against Bosniaks Muslims. This hatred and prejudice fuel their continued Srebrenica genocide denial.

KRSTIC LIED TWICE

In 1998 Krstic and his family emigrated to the United States. As part of a refugee application, he filled out an I-590 form, which requires, among other things, applicants to disclose foreign military service. He denied having served in the military "during a sworn, personal interview administered in Belgrade."

In 1999, he applied to become lawful permanent residents. As part of the application, Krstic filled out an I-485 form, which also asks applicants to report any prior foreign military service. Krstic again refused to disclose his service in the genocidal army. As a result, he fraudulently obtained a green card.

ADMITTED LIAR

According to The Oregonian, in 2005 the International Criminal Tribunal for the former Yugoslavia reported to U.S. immigration authorities that Krstic had, in fact, served in the Army of Republika Srpska. The alert prompted federal U.S. agents to visit Krstic’s home near Beaverton and interview him. Krstic admitted to actively serving in the genocidal army, but he denied committing any war crimes.

Whether he took part in the mass killings is irrelevant. The fact that he assisted the genocidal army - by serving as an active member and providing logistical support to the genocidal Bosnian Serb terrorists in and around Srebrenica - speaks volumes about Krstic's character.

Krstic's militia, also known as the Bosnian Serb Army, has been designated by the International Court of Justice in The Hague as having participated in war crimes, genocide and ethnic cleansing during the Bosnian war in the early 1990s. Federal court files show that the U.S. government also learned Krstic's specific unit, the Zvornik Infantry Brigade, was "involved in the massacre of a large number of unarmed Muslim prisoners in 1995, in areas in close proximity to (Krstic's) duty station." A prosecution document said that one mass killing was at a school "in close physical proximity to battalion headquarters where records show that defendant was working at the time."

PARTNERS IN CRIME?

Krstic's brother Ostoja also seems to share Srebrenica genocide blood on his hands. According to the Associated Press, "Lawyers involved say two similar federal cases are pending in Oregon, one involving Milenko's brother, Ostoja, and are on hold pending the appeals in Milenko Krstic's case." Milenko Krstic is currently charged for committing a visa fraud. If convicted, he could face up to 10 years in jail and be deported to Bosnia, where he assisted the Serb army in committing the 1995 Srebrenica genocide.

U.S. immigration officials are investigating the father of the reigning Miss Oregon on suspicion of visa fraud after an international war crimes tribunal reported that he had served in a military unit that slaughtered unarmed Muslims in Bosnia in 1995.

Federal prosecutors say that Serbian national Milenko Krstic, 52, father of Miss Oregon Danijela Krstic, 24, lied in 1998 when he was applying for refugee status, stating under oath that he had never served in the military.

Six years after Krstic settled in Beaverton in 1999 with his wife and two daughters, the International Criminal Tribunal for the former Yugoslavia reported to U.S. immigration authorities that Krstic had, in fact, served in the Army of Republika Srpska.

Krstic's militia, also known as the Bosnian Serb Army, has been designated by the International Court of Justice in The Hague as having participated in war crimes, genocide and ethnic cleansing during the Bosnian civil war in the early 1990s.

Federal court files show that the U.S. government also learned Krstic's specific unit, the Zvornik Infantry Brigade, was "involved in the massacre of a large number of unarmed Muslim prisoners in 1995, in areas in close proximity to (Krstic's) duty station."

The investigation came to light this week when a 9th U.S. Circuit Court of Appeals ruling cleared the way for Krstic's prosecution on charges of visa fraud.

A three-judge panel rejected Krstic's argument that he couldn't be prosecuted for possessing an authentic immigration document, or "green card," even though it had been obtained by means of a false statement.

Krstic's daughter Danijela was crowned Miss Oregon in July 2008, the first foreign-born winner in the pageant's history.

She spoke openly about her family's struggle to escape the war-torn country of her birth. She mentioned her father's military service in an interview with The Oregonian but shied away from providing specific details, saying only, "There were no good guys. It was just a mess."

"She knew"

Reached at his home, Krstic said his daughter understood his visa troubles when she competed for Miss Oregon last summer. "She knew," he said.

Krstic denied committing war crimes.

"I don't have any connection with any crime in my life," he said.

Krstic worked as an engineer in the Bosnian city of Banovici until civil war broke out in 1992, this week's ruling states. After Bosnian authorities imposed curfews and employment restrictions, Krstic and his family fled to several war-torn locations throughout Serbia and Bosnia-Herzegovina. Eventually, Krstic was conscripted into the army. In court records, he maintains that he spent the following three years performing "office work and other clerical tasks."

In 1998, three years after leaving the military, Krstic and his family emigrated to the United States. As part of a refugee application, he filled out an I-590 form, which requires, among other things, applicants to disclose foreign military service.

Krstic contends that "someone wrote 'not served' in English" on the form. Federal officials, however, say that Krstic denied having served in the military "during a sworn, personal interview administered in Belgrade."

Krstic and his family were granted refugee status and admitted to the United States. They settled in the Portland area.

In 1999, the family applied to become lawful permanent residents. As part of the application, Krstic filled out an I-485 form, which also asks applicants to report any prior foreign military service. Krstic again did not disclose his service. He was issued an alien registration receipt card, also called a green card.

In 2005, the International Criminal Tribunal for the former Yugoslavia reported Krstic's military service to U.S. immigration authorities. Federal agents entered Krstic's home and interviewed him. He admitted to serving in the military but denied committing war crimes. On Dec. 11, 2006, about seven years after Krstic completed his permanent resident application, agents seized his green card.

A grand jury for the District of Oregon returned an indictment against Krstic. Filed on Oct. 16, 2007, it alleged that Krstic "did knowingly possess an alien registration receipt card ... which he knew to have been procured by means of materially false claims and statements."

Krstic moved to dismiss the indictment, contending that possessing an authentic immigration document procured by means of a false statement was not a crime. He argued that the law criminalized possession only of an already forged, counterfeited, altered or falsely made immigration document. The district court agreed with Krstic and dismissed the indictment. The United States appealed.

This week's ruling reversed the district court's decision.

Krstic's lawyer, Assistant Federal Public Defender Christopher J. Schatz, said Thursday that he plans to pursue other appellate remedies and will "take the case to the U.S. Supreme Court if I have to."

"A peacemaker"

"There is not a scintilla of evidence that Mr. Krstic had any knowing or direct involvement in any of the atrocities committed by members of the Zvornik Infantry Brigade," Schatz said. "Investigation activity conducted in Bosnia including interviews with Bosniaks, Bosnian individuals of the Muslim faith, has confirmed that Mr. Krstic was involuntarily conscripted by the Zvornik Brigade and that prior to that time, his reputation among all elements of the Bosnian-Herzegovinian society was that of a peacemaker."

If the case against Krstic proceeds and he is convicted of visa fraud, he could face a maximum penalty of 10 years in prison and a fine of $250,000. He and his family also could be deported, immigration officials said.

"I can't speak specifically to his case," said Lorie Dankers, spokeswoman for the U.S. Immigration and Customs Enforcement (ICE). "But if a person receives their immigration benefit based on a family member who got theirs fraudulently, then an immigration judge may find that family members could lose that benefit as well."

Danijela Krstic did not respond to a request for an interview.

Danijela Krstić, rođena u BiH, aktuelna je miss američke države Oregon koja će se 24. januara takmičiti sa još pedeset djevojaka za titulu miss Amerike u Las Vegasu, piše srbijanski Blic.

Danijela je sa porodicom izbjegla u Ameriku iz ratom zahvaćene BiH, uz mnogo truda i volje savladala mnoge životne nedaće, a sada je na putu ostvarenja svojih snova.

Danijela Krstić rođena je u BiH, gdje je do rata živjela sa roditeljima i starijom sestrom. Međutim, njeno do tada sretno detinjstvo naglo je prekinuto kada je imala samo osam godina.

- Morali smo da ostavimo sve za sobom, a kada ste dijete, mnogo toga ne razumijete. Moje iskustvo iz djetinjstva naučilo me je da vam život kakav poznajete može biti oduzet preko noći i da materijalne stvari ne vrijede ništa u poređenju sa ljubavlju - rekla je Danijela za Blic.

Porodica Krstić, otac Milenko, inženjer, majka Branka, sestra Aleksandra i Danijela postali su izbjeglice koje su utočište nalazile kod bilo prijatelja, a budući da su bili bez novca, svu odjeću su morali da pozajmljuju. Krstići su odlučili da se isele u Ameriku, međutim, proces provjera, pribavljanja dokumenata, viza, intervjua i odobrenja bio je dug i mučan, ali su uspjeli i zaputili se u gradić Bethany u Oregonu. U Bethanyju su neko vrijeme boravili kod bliskih prijatelja, da bi se zatim preselili u iznajmljeni stan. Danijela, kojoj je tada bilo 14 godina, i njena sestra nastavile su školovanje u obližnjoj srednjoj školi.

Nakon srednje škole Danijela se upisala na državni univerzitet Portland, a dvije godine kasnije prebacila se na Oregon institut za tehnologiju, gdje je diplomirala kao zubni tehničar i specijalista za oralnu higijenu. Prije dve godine, kao dvadesetdvogodišnjakinja, prijavila se za lokalno takmičenje za miss smatrajući da će tako zaraditi dodatni novac za školovanje.

Pobijedila je i postala miss Klamath okruga i tako se plasirala među 10 kandidatkinja koje su se takmičile za mis Oregona, a Danijela je tu titulu i osvojila 2008.

Nakon pobjede, Danijela je izjavila da je za nju ova titula dokaz da se rad i vjera u sebe isplati. Djevojke koje učestvuju na takmičenju za miss Amerike trenutno se pripremaju na krstarenju luksuznim brodom ”Queen Mary”.

Milenko Krstić pod istragom američkih vlasti zbog lažne izjave da nije učestvovao u masovnim ubistvima Muslimana u Srebrenici

Posedovanje autentičnih useljeničkih papira dobijenih na osnovu lažne izjave jeste krivično delo, odlučio je Deveti apelacioni sud Sjedinjenih država, čime je omogućena istraga američke imigracione službe protiv Milenka Krstića, bivšeg pripadnika jedinice Republike srpske koja je učestvovala u masovnim ubistvima srebreničkih Muslimana. Krstić je danas otac nedavno izabrane mis američke države Oregon, Danijele Krstić.

Kako prenosi kalifornijski dnevni list Metropolitan News-Enterprise, slučaj se povlači po američkim sudovima od 2005. kada je Tribunal u Hagu dostavio američkim vlastima dokaze o Krstićevom učešću u ratu u Bosni. Krstićevi advokati su odbranu zasnivali na vezniku "ili" iz dela američkog krivičnog zakona koji se bavi prevarama, zloupotrebom viza, dozvola i drugih dokumenata, na osnovu čega je Okružni sud Oregona odbacio tužbu protiv Krstića.

Kako prenosi list, Milenko Krstić je bio pripadnik vojske Republike Srpske tri godine, između ostalog i u vreme masakra u Srebrenici 1995, u čemu je učestvovala i njegova jedinica. Kada je 1998. godine aplicirao za status izbeglice u Sjedinjenim Državama, tokom razgovora sa osobljem američke ambasade u Beogradu negirao je da je bio pripadnik bilo kakve vojske. Istu tvrdnju ponovio je i naredne godine kada je aplicirao za boravišnu dozvolu. Kada je pokrenuta preliminarna istraga, Krstić je priznao da je bio pripadnik vojske RS ali je negirao da je počinio bilo kakav zločin.

Apelacioni sud je odlučio i da je period od pet godina, kada slučaj zastareva, počeo tek 2006. kada je Krstiću oduzeta Zelena karta.

Posebnu pažnju američkih medija slučaj je, naravno, dobio zbog činjenice da je Krstićeva ćerka, Danijela, izabrana za mis Oregona, čime se kvalifikovala za izbor za mis Amerike.
