Under Article 21(2) of the 1999 Montreal Convention, the airline is liable for all of the plaintiff’s damages unless the airline proves that it was completely without fault, or that the accident was caused solely by the fault of a third party. Unlike most laws that place the burden on the plaintiff to prove his or her claim, the Convention imposes on the airline the duty to prove its lack of fault. In this case, it remains to be seen whether the investigation will identify evidence that will allow Malaysia Airlines to mount a defense under Article 21(2).
